And it was great to be away. I still was working on a variety of things, but it was great to to step away for just a little bit. So thank you again. And we’ve got so much going on right now. Through the lens of freedom versus force, force versus freedom, if something’s a good idea, you should not have to force people to do it. And it’s never compassionate to take other people’s stuff, whether or not it’s their rights, their property, freedom, livelihood, opportunity, childhoods, or lives via force. Force can obviously be a weapon, but policy requiring compliance, unpredictable and excessive taxation, fear, coercion, government-induced inflation. The agenda of the World Economic Forum, which we’ve seen play out at the United Nations, also with this Colorado governor, this Colorado state legislature, but also at the local level. And it is remarkable to me. A perfect example would be the city of Lakewood not listening to the people. The city of Lakewood is pushing this agenda of subsidized government housing. and not listening to the people. And in a way, it looks to me like the mayor and many of the city council members of Lakewood are acting like kings. And I have to agree this protest that’s going to be on the 18th of October. It’s actually a protest that’s being organized by the left against Donald Trump, and it’s called No More Kings. I do agree with him as far as America was founded really because there was so much frustration with the monarchy. But a monarchy isn’t just sometimes one person. It’s really an agenda, and it’s an agenda where government is controlling people’s lives. And we are seeing that play out in a number of the local governments here in the metro area. And I would say the city of Lakewood, the mayor and the city manager and many of the council members are acting like kings. And I would say no more kings over there in Lakewood. And so we’ll continue to shed light on that here throughout the week. But I do appreciate Laramie Energy because It is reliable, efficient, affordable, and abundant power. And it’s from naturally occurring hydrocarbons, such as oil, natural gas, and coal, that powers our lives, fuels our hopes and dreams, and empowers us to change our own personal climate, to be warm in the winter and cool in the summer. And all of that is under attack. And we have to ask why. And again, it is an agenda by a king-like agenda that wants to control our lives, keep people pushed down. And the elites certainly have access. You look at John Kerry, and he’s flying all over the world in these jet-powered airplanes and requiring jet fuel. So it’s okay for him, but not for the rest of us. The other thing I found really interesting, and I was just thinking about this the other day as I’d gone down to the Capitol to testify this last legislative session on a particular piece of legislation, and the kings down there at the state legislature said, are hiding behind the Colorado State Patrol, which provides security for the state capitol, and they have firearms. And so all of these legislators that are acting like kings are hiding behind the Second Amendment to protect them, but yet they are working to try to take away our property. right, our Second Amendment right to keep and bear firearms to protect ourselves against bad actors. And that, again, is something that a king does. And so I just want to continue to address this narrative out there because I’m sure that there’s going to be colleagues, family members that are going to be in a rage about no more kings as the left is organizing this protest on Saturday. And interestingly enough, when I was looking information up about it, it said on Amazon, you can go on Amazon and order your No More Kings shirt. So stay tuned. This is going to be very, very interesting. Probably the biggest headline is what happened yesterday regarding the peace deal with Israel and Iranian-backed Hamas terrorists. And this is from Newsmax. And Richard Grinnell told Newsmax on Monday that President Donald Trump is the only world leader capable of achieving the historic peace deal that ended more than two years of war between Israel and Iranian-backed Hamas terrorists in the Gaza Strip. And on Rob Schmidt tonight, Grinnell, Trump’s envoy for special missions, said the agreement, which secured the release of all living hostages held in Gaza earlier Monday, marked a moment of history and a testament to Trump’s credibility and his leadership. This is really remarkable. And we have to be very grateful for this particular development. And so thank 20 Israeli hostages were reunited with their families after two years. Just think about what a waste that is to be held a prisoner for two years. Just think about the lack of two years of not being able to create and innovate and work and love your family. But this is pretty amazing that that happened. that that has occurred. A couple of things I did just want to mention is our word of the day is superfluous. And it is spelled S-U-P-E-R-F-L-O-U-S. It’s an adjective. And it could be to overflow, being more than needed, useful or needed. Number two, not needed or wanted, surplus, excessive. And number three, it could be unnecessary or irrelevant. And I would say that we have so many laws, so many superfluous laws in our country. And we are a country that is a country of laws, but those laws have to cut the muster of this vision of our declaration that all men are created equal. So that means that we are all treated equally under the law with these rights from God of life, liberty and pursuit of happiness. And things that are outside that, that are treating people impartially, or partially, I should say, that’s not okay. And things that take away people’s liberty. And all those things are so important. So because we’re going to be talking with Rob Nadelson in the second hour. He’s written the book, The Original Constitution. I went to the father of the Constitution, James Madison, for our quote of the day. And he said this. If man is not fit to govern himself, how can he be fit to govern someone else? And James Madison was born in 1750 or 1751. He died in 1836. He was an American statesman, diplomat and founding father, the fourth president of the United States. And he’s been acclaimed as the father of the Constitution. And so education and the quote that we have for the end of the day is regarding knowledge. And a couple of things to mention on that. We did roll out our voters guide for this 2025 election. We took positions or I took positions on both of the statewide issues and also the five elections. big debt questions on the Denver ballot, but I also included a list of a number of the questions that are on local jurisdictions. There’s some wild stuff out there. Again, trying to take more power away from the people at the local level which is what Kings try to do. So take a look at that. I also did include all of the county clerk’s phone numbers and gave you a strategy on how to find out about school board members and get their information, call them, and also mayor candidates and city council candidates. But we are into election season. Ballots were sent out. They’ll probably arrive in your mailbox today. And on the line with me is Jamie Lynn Davola. She is running for reelection for Falcon School District 49. Jamie Lynn, welcome to the show.

Hi, Kim. Thank you so much for having me on. I really appreciate it.
SPEAKER 06 :
Well, it seems like just yesterday we were talking when you were running for election. And has it been four years already?
SPEAKER 07 :
I can’t believe it. I blink and all of a sudden my kindergarten daughter is in fourth grade.
SPEAKER 06 :
That is impossible. These school board races, Jamie Lynn, are so important. As I’ve looked at a number of school districts across Colorado, there are school districts where kids, Maybe 70% of the kids in third grade cannot read and write and do math at proficiency. That’s unconscionable. So you’ve had four years now as a school board member or school board director. What should people know? What have you learned, and why are you running for re-election?
SPEAKER 07 :
So something that’s really important is making sure that we are teaching students reading, writing, and math, and not putting other things in the schools that are going to hinder that. And so one of the biggest issues that parents have found, and you’re actually mentioning superfluous laws that are happening in the country. Well, we have several in the state of Colorado that’s trying to strip away parental rights. And so House Bill 1312 was one of them, And we as a district decided to take a firm stand against that because of it stripping the parental rights and distracting away from being able to do what we’re supposed to do. We’re supposed to be able to teach reading, writing, and math and not have to think about issues that are completely distracting in the classroom, such as transgenderism. That is a huge problem in all of our schools. These kids are so confused about who they are as a person and who they are created to be that we have a mental health contagion in our classrooms that are distracting us from being able to learn. And so we as a school board, Lori Thompson, who’s also running for reelection with me, as well as Deb Schmidt, she’s not up for reelection, but she’s on our board. And I voted to take a stand against this transgenderism nonsense that’s happening in our schools. And so we have a policy now in place where we are protecting our female athletes by not allowing biological boys to compete as girls on our female sports teams or to be in the same bathrooms and locker rooms. We have actually had issues with female students who are concerned about going into the bathroom with an 18-year-old boy. That’s a huge problem. If we can’t use the bathroom without thinking or fearing that somebody else is going to be in that bathroom, that… is not a girl. Um, how are we supposed to focus on academics? And this is a huge concern. Like I’ve been door knocking, um, and, um, talking to people about the, uh, the races and the number one concern that, that parents are having right now is, are my, is my daughter going to be safe? Are we going to be able to have a fair competition on our sports fields? Um, and, um, I would say the majority of the people I’ve talked to, as soon as I say that D-49 has taken a stand against this stuff, they’re like, you’ve got my vote.

Okay, so Jamie Lynn, I think it’s really important that we reiterate your name, the name of your colleague that is running for re-election. You mentioned Deb Schmidt. I think she’s probably up for re-election in a couple of years, maybe, yes? In two years. Okay. How many members are on this school board in Falcon School District 49?
SPEAKER 07 :
So there are five members. Okay. On the school board, and it’s now been renamed. It’s actually El Paso County School District 49 because we also include part of Colorado Springs. And so, yeah. But, yes, there are five of us. Lori Thompson is running in Director District 4, and she is – I need her because her and I have really been able to – to do what we need to in order to take a stand against, especially the local control issue that you were talking about, too, is we need to have local control as a school district so that we can push back against the state of Colorado and their superfluous laws.
SPEAKER 06 :
Oh, and you’re doing such a great job of the word of the day. Congratulations. Jamie Lynn, how can people get more information? And is your opponent receiving money from the teachers union, which we’ve learned the teachers union doesn’t really care about students and it doesn’t really care about teachers. It cares about power and pushing an agenda. Are you up against anybody that’s receiving support from the teachers union?
SPEAKER 07 :
So luckily, because we are a school district that is not a contractual district with a union, that helps a lot. We do not have a master’s agreement with the union. However, we do have teachers that are in a union or who have, you know, personally decided to pay to be in there. And, yes, that other person is being supported by people who are in the union. And so, yeah, I do have two opponents, actually. I have Holly Withers, who is supported with a group that’s a part of the teachers’ union. And then we do have Ivy Liu, who’s running against me in my same seat. who has a personal vendetta against the school district. And so I do have a very challenging race, but I am very encouraged that the majority of people I’ve been talking to love what we have been able to do, especially with our parents’ Bill of Rights. We voted on that back in 2022 to put full transparency on the table and not allow school administrators or school personnel to hide things from parents. So that has really helped as well.

Let’s do. Let’s talk. Yvonne Paez was on yesterday, and she is handling the logistics of the petition gatherers and the petitions. And Erin Lee was on yesterday as well. But what is your update? Because you’re working closely with them, with Protect Kids Colorado. What do you want people to know?
SPEAKER 10 :
well uh you’re right those those are a couple of the most important people we have with this campaign i’m i’m the chairman of the board so you know the buck stops here in a sense but i’ve got good people working with me in a lot of a lot of ways and we have hundreds uh really over a thousand people who’ve stepped up and said give me a petition or more and they are spread out all over the state i’m hearing reports of uh just, you know, innumerable people signing the petition. Now, it may be innumerable right now, but we need to numerate that because we need about 200,000 people to step up and sign all three of these petitions to be guaranteed a spot on the ballot next year. I am very encouraged, but I’m also trying to crack the whip and say we’re not done. There’s a lot more to be done. And if anybody hasn’t become a part of this yet, I urge them, I urge them to go to the website, protectkidscolorado.org, and sign up. grab some petitions. We’ve got them spread out in lots of different places around the state and start collecting signatures. Just do it in your circle of friends. Each petition holds 40 signatures and that’s a task that can be done in the next two or three months. We’ve got until Really, the final, final drop-dead date is the 1st of February. But that’s when we have to have everything done, everything collected, everything collated, everything organized and delivered to the Secretary of State. So we really need to get this done in the next couple of months, at least the bulk of it. So, yeah, I’m just thrilled with all the people who are doing so much in so many ways. I think we’ve got a decent shot of making this happen and changing the conversation of what’s important here in Colorado to the Colorado voter in 2026. I mean, this has ramifications. These are very important issues. But I believe it’ll radiate out to other issues as well as the people of Colorado step up and say, so what do we want done in this state?
SPEAKER 06 :
Well, and people can get the information by going to protectkidscolorado.org. And you can sign up to become a petition carrier. But also you’ve got the ballot language for each of those three measures. And, of course, protecting children from sex trafficking. It’s like thinking, who would be against that? Of course we want to do that. Protecting children from irreversible sex change procedures. Yes, that makes a lot of sense. And protecting girls, single-sex sports, and locker rooms. All of these things make so much sense. And it’s almost crazy that we have to do ballot initiatives to solidify this.
SPEAKER 10 :
Actually, let me jump in. You’re right. It seems almost crazy except for the fact that the current folks in charge down in denver at the capitol they think going the opposite direction is the way to go um i i mean it it makes no sense whatsoever except for the fact that it really is what’s happening in colorado so this this isn’t just you know some oh let’s let’s tweak a little thing here or there no let is let’s stop the policies that are in place right now dead in their tracks and go the opposite direction, which is the right way for the best of Colorado, for the best of the children in Colorado, for the families. Just everything about this just points to it has to happen. And that’s why I’m so passionate about this issue.
SPEAKER 06 :
Well, and Aaron Lee has really become such a voice on this. Their family has a case that they’re hoping will be heard by the Supreme Court. And as I said, I had stepped away for a few days. Do you know what is the update? I’m sure Aaron talked about it yesterday, but what’s the update on that, Kevin?
SPEAKER 10 :
Well, we don’t know yet, but we should soon. or at least we should know a little bit more, because there are about 10,000 cases that are submitted to the Supreme Court every year, and so it’s kind of rare that they actually say, yeah, this is one of them. But all of the indications were that they want to take something in this area, and there are a couple of cases out there. The Levy-Pooter, I think, is the most direct, and the best one with the merits, and to simply say, to tell school districts exactly what you were talking to that candidate for school board, you know, in the earlier segment. Yeah, that parents need to be in charge of their kids even when they’re in public school. But again, it’s the exact opposite here in Colorado. That’s not the policy. And that’s what the Lees encountered with their oldest child when she was 12 years of age. And the school set up a system that ultimately convinced this girl that she wasn’t a girl. And, you know, we made a film about it called Art Club, which I call it a horror film with a happy ending because they did work through this. But they know that that shouldn’t be the path for every family and for every child in this state. So anyway, it’s an important issue. It’s before the court. This is the time of the year that the court figures out what are we going to be hearing in the next several months. It went to conference consideration, which is the way they work things. The justices get together and say, OK, what do we want? And, you know, there are enough votes are for a particular measure. They do hear it. What they did with this case, Levi Pruder, is they rescheduled it for a second conference meeting, which is a really good sign that they’re looking at it. And that was to be held last Friday. So really, we’re expecting an announcement very shortly as to what happened. Did they… Turn it down? Did they accept it? Did they maybe ponder on it a little bit further? Because the courts can go, you know, they aren’t locked into anything. They do what they think is best. But, yeah, we might know earlier or later this morning if they, you know, publish what their decisions were for last conference meeting. So stay tuned. Soon we’ll be on track.

Okay. Well, you’re the one running the show, so you know more of the details than I. But it’s up in my neighborhood. It’s at Resurrection Fellowship just off I-25 in the Loveland area. And there will be a time to just meet individual candidates. They’ve got tables set up. And also, I will say that there will be petitions to sign for Protect Kids Colorado. We’ll have a table there, too. So if you want to check it out for that reason, that’s a good thing, too. But you can talk to people, these candidates individually, and then there will be a forum. I don’t know how the moderator is going to moderate 16 different people on each issue, but that’s your problem.
SPEAKER 06 :
I’ve been thinking about that, Kevin. It will be monumental. And typically, yeah, typically I run a pretty tight ship on these when I moderate, and I want to treat everybody fairly and impartially. And so that’s my goal.
SPEAKER 10 :
Now, I’ve actually moderated a couple of forums for gubernatorial candidates this year, but it’s been like three or four people at each event, and even that’s a daunting task. I have a suggestion, and that is a lot of popcorn questions. You know, just give me a yes or a no. Boom, boom, boom, boom, boom. I think that’ll give people a little bit of a picture. But then you’ve got to give everybody a chance to speak their mind, to actually really give people an idea as to who’s up there. There are some good people. I think there are a few folks that probably won’t get very far. And, of course, we’re going to end up with one eventually. And there’s still a lot of time. Before we come to that final determination. So who knows, there might be another 10 people to step up. But everyone recognizes that this coming year might be the real opportunity for a Republican to become governor in the state of Colorado. If you look back over the history, we’ve only had one person. That’s Bill Owens, who was governor in the last, what, 50 years or so, 40 or 50. I haven’t added up precisely. And so finally, though, the polis and all the other statewide elected officials are termed out. So it’ll be, you know, new faces in every slot. on both for both parties. So, well, I’m excited. Yeah.
SPEAKER 06 :

What about, I find it so interesting, we have so many candidates for governor. I know that we have one candidate for state treasurer. I don’t know that I’ve heard of anybody for secretary of state. What do you know about this?
SPEAKER 10 :
Well, not much more than you do. I do know that about this time back in 2018, there were, I think, ultimately we had seven people running for the state treasurer spot. I was one of them. That’s why I know that. And, yeah, remarkably, there’s only one, Kevin Grantham, who’s running, who used to be Senate president there. And the Secretary of State, I haven’t heard anybody step up yet. That’s going to be an interesting position because there’s a whole lot of things that have to happen in the Secretary of State’s office to right the ship there. Janet Griswold has just said. She has changed the rules around. And really, I think we’ve got a lot of things need to be corrected in that office. And I’m hoping that we have somebody who’s competent and qualified and committed to getting this job done.
SPEAKER 06 :
Well, and that is very important, and perhaps maybe one of these candidates for governor might move over there. I think that might be a great opportunity.
SPEAKER 10 :
And that brings up an interesting point, too, because if I were one of the gubernatorial candidates right now, I would be looking around the rest of the field and thinking, okay, I’m going to need a cabinet. I’m going to need a lot of people in good positions. Who among these candidates can do this? That’s what Donald Trump did. You know, I mean, RFK Jr. was running as a Democrat and then an independent. And And he, you know, plugged him into HHS in a very, very strategic move. Tulsi Gabbard, she, not this go-around, but she had run for president as a Democrat as well. And, you know, she’s doing a bang-up job for him. And, you know, several others as well. Marco Rubio, he had run for president years ago. So… Among the people that will be on that stage on Saturday, you might look at it and say, this could very well be not just the future governor, but the future team that that governor will use to fill everything out. And so I trust that they will be thinking in those terms, too. Here’s an important principle I believe that we need to always apply. Ronald Reagan called it the 11th Commandment, which is speak no ill of your fellow Republicans when running for office. Don’t try to beat them up. Just try to shine as the best possibility out there and recognize that these are your friends and these are the people that you’re going to have to govern with if you are successful. And I think we’re going to have a real winning combination if you stop beating each other up and just start looking after the people’s business first and foremost to give good governments with limited governmental authority and power and maximum freedom for individual citizens.

And one of the things that you mentioned in the Lundberg Report that was published on Saturday was that Dominion Voting Systems has been sold to a Republican. So break this down for us a little bit.
SPEAKER 10 :
Okay. Dominion, of course, is the election system that most counties in Colorado use for tabulating and running the elections, really, start to finish in many ways, as well as I understand they’re in like 40 states. And there are a lot of questions a lot of us have as to just how their software works. This is, of course, the system that Tina Peters was thrown into prison because she had the audacity of actually preserving the records from their software, which she had the responsibility to do as a clerk. Dominion has been so secretive and so defensive in their equipment And there are so many questions as to whether or not their equipment is is counting things correctly. I’m just I’m trying to be generous with this. And it seemed like just an intractable problem, because any time you would ask a question like for Tina, they throw her in prison for most people. prominent people that have really questioned this. They throw a billion-dollar or billion-plus-dollar lawsuit at them, which is just unimaginable. And news services like Newsmax, they just folded and paid Dominion millions of dollars in a settlement just so they’d go away. Anyway, we get the news last week that the whole system was sold and was purchased by somebody who’s in the election process. equipment business, but is ostensibly a Republican who has voiced some support for election integrity. And so I’m very encouraged by this, but not so fast. Let’s let’s let’s be rather careful about this, because some people who are in the know have talked to me and said, we have to make sure that this is being done for the right reasons by the right people. One question in my mind is, where did this guy come up with the money? The undisclosed amount is a private sale, so we don’t know. But why did the original owners of Dominion sell it lock, stock, and barrel, and there was a provision that they drop all the lawsuits against the people that they were pursuing. Now, some they’ve already destroyed. It’s just, you know, for years they have been on this war path.
SPEAKER 06 :
And who is this guy? He is the founder and chairman of Liberty Vote. His name is Scott. It looks like it’s Leon Decker. Who is this guy? How could he have the money? And as you mentioned, it’s an undisclosed amount. There’s a lot of questions. I’ve reached out to some of the people on the national level. And they’re not encouraged by this particular sale. So to your point, I think we wait and see. But I don’t know anything about this guy. Where did he get the money? How much? There’s a lot of big questions about this. And why would Dominion sell to a Republican when they have been so secretive with their software? There’s just a lot of unanswered questions on this.
SPEAKER 10 :
There are, but first and foremost, You know, if you’re in the political arena, I’ve discovered that you’re either optimistic or you’re suicidal. And I choose optimism, okay? So here’s the possibilities I see. Why did Dominion sell? Well, it could be that they saw the noose is tightening because Trump and his administration have been really looking into these things. And it could be that they realized that the jig was up and they were going to be finally exposed and you know, maybe sent to prison themselves. A lot of people have suggested that we’ve got the wrong person in jail, which I quite agree as well. Tina Peters, I don’t think she did anything wrong. I think she did something courageous, and she’s being persecuted for it. But there are some bad actors that have done some pretty bad things that we’re very well aware of. And so that’s one reason Dominion might have finally figured out that they better cut and run, maybe. But it could be a bit of a PR stunt on the part of the bad actor players to say, well, let’s put up this supposed good guy, and then we’ll change the name. Dominion will go away, so we’ll rebrand it and call it Liberty, which sounds nice. But here’s the positive side, is they built some expectation that things are going to change. Now it’s up to us to insist that they do change, that we go back to a voting system that is transparent, that is local, that is immediate, that is not full of so many vulnerabilities for bad actors cheating. And I think if nothing else, we might get a respite for the next election cycle. which, again, makes me hopeful for 2026. But now is the time to really put the scrutiny to this whole situation. So I am cautiously optimistic, but I know we have to be vigilant in searching this out and digging deep and making those who claim that this is a really good idea to prove that not with assurances, but with evidence, with real progress towards a good system that works well. And I know we’re running out of time, but maybe we can pick up and deal a little bit more with this in future broadcasts.
SPEAKER 06 :
Yeah, I think so. And this is coming in from Gammy, and it’s a good question. I’m going to paraphrase. But will the new owner of Dominion have access to all of the previous records? What’s that going to look like? So there’s so many questions about this. And this 2026 election is important. And I’ve been frustrated. As you know, we have our two lawsuits out there, as well as our Jefferson County prevalence study. And, man, the legal system moves so slowly, although it moved pretty quickly against Tina Peters. But it can be just so slow. And I’m so frustrated with that, Kevin. We’ve got about a minute left. And you have a lot more experience on this than I do. So what’s your comments on that?
SPEAKER 10 :
Amen. I agree. You know, the lawsuit that the GOP filed, and I’m the chairman of the committee that’s overseeing this, challenging the open primary system we have in Colorado. We filed that over two years ago, and we’re still waiting for the judge to set a trial date. Gone through all the preliminaries. It’s just sitting on his desk. And when I talk to our legal folks about that, they say, well, it’s up to the judge. I see a lot of foot dragging in a lot of ways. And so, yeah, you’re right. Again, that’s why I say vigilance. And if we can’t force a judge to move on these things, well, we can let everybody know what a bad job they’re doing in that regard. So, you know, we’ll wait and see a little bit, but let’s stop waiting and let’s start looking really hard.

Well, and that’s why what you’re doing, what we’re doing is so important. And it’s a great segue into our quote of the day from James Madison. And it’s great to be back. I’ve missed all of you. It was nice to take a little bit of time, but it is great to be back. We have so much to do to reclaim this beautiful state of Colorado. Denver has become dirty and dangerous and dysfunctional. our state as well and that’s why these elections are so important check out my voters guide i took positions on the two statewide issues which it’s uh for the children this is one of those things it’s so it’s really brilliant from a marketing standpoint it’s healthy school meals for all children are what these two uh questions are about we already have a federal or a national lunch program. This is really a takings from people that make more than $300,000 a year. And beware, I know that, and so it’s based in a way on envy, that, oh, those people are making that money, they can give up a little bit more to pay for healthy school meals for all children. But there’s all kinds of bureaucracies that will be created because of this. They’re looking for nearly another $100 million with Proposition MM, from people that are earning more than $300,000, which typically that may be your entrepreneurs, that may be your small business owners after they’ve gotten to a point where they are successful, but they put in so many hours to make that happen. And so to treat them Partially to to treat them differently. That’s antithetical to the American idea. So both those proposition LL and what that proposition LL is, is the state of Colorado in well, in 2022, it was on the ballot. and it was healthy school meals for all children, put in place new bureaucracies. They said they were going to raise $107 million. They actually raised $12 million more. So Prop LL says, oh, we want to keep that money as well. So when people talk about greedy corporations, let’s talk about what’s really greedy, and that is government. And the problem with government is they have the resources. uh… they have force behind them they can forcibly take that money and uh… so i would recommend no on both of those we also took positions on the five different bond questions for denver which again very disingenuous on the language they say without increasing tax rates something like that i’ll have to take a quick look at it uh… but in fact the weather wanting to do is extend debt well if you pay off your car your payments go down. They’re saying they want to keep those payments basically into perpetuity is what we’re seeing with government. So check out the voter’s guide. That’s at kimmonson.com. And taxation is a real problem. I think people believe that government has a proper role and there is a proper amount of taxation, but when it gets out of control, well, Our country was founded because of excess taxation. And so we need to understand what’s going on. And one of the things that kings do is they take the root of people’s labor for themselves. And we’ve got this protest coming up on the 18th of No King’s Day, which is being organized by the radical left. and really against Donald Trump saying no kings. And I agree, no kings. But what a king does is they take the fruits of your labor and they control your lives. Well, we’re seeing that play out. And local governments, here we have Denver, will be asking for almost a billion dollars to extend debt. And that is money that is taken from we the people. But then The payback on that, I’ve got to figure out exactly what it is, but it’s probably close to double. And again, kings take the fruits of people’s labor, and how do they do that many times? Through taxes and fees. And there are those on both sides of the aisle that do in elected office, and then of course all these bureaucrats, these city managers, and all these bureaucrats, that they are making king’s ransom salaries. For example, the City manager in Lakewood is just salary alone is making just south of $400,000. That’s pretty significant. And so we will continue to have these discussions. Two things I wanted to mention. The word of the day is superfluous. And it is spelled S-U-P-E-R-F-L-O-U-S. And it could be to overflow, be more than needed, useful or useful, not needed or wanted, surplus, excessive, irrelevant. And our challenge is to use the word superfluous in a sentence today. And I would say all of these different words. Laws and ordinances are really superfluous, and we need to be reclaiming freedom. Our quote of the day is from James Madison. He was born either in 1750 or 1751. He died in 1836. He was an American statesman, diplomat, and founding father. He was the fourth president of the United States and is known as the father of the Constitution because of his contributions to writing the Constitution and the Bill of Rights. And he said this, if man is not fit to govern himself… How can he be fit to govern someone else? Very good point. That’s why the education of our children is so important. Being able to read and write and do arithmetic, all those things are so important. And as you all know, that we are an independent voice on an independent station. that happens and on the voter’s guide there was no nobody paid me to do this no corporation or anybody said you know what stand we needed to take i looked at this these issues as what is best for the people of colorado and that made the case for my recommendation you may disagree and that’s okay but my hope is is that you will have a tool that will really help you think about these issues. Well, and John, I am making recommendations, but I put hopefully enough information there that people think about it. What I have seen is that consultants on both sides of the aisle, they don’t really give the whole story of what the ballot question is. And they’re just trying to influence people to vote, vote, vote, vote, vote. And I want people to start to really think about the issues. And so hopefully we’ve given them a lot of information. And then I included, one of my neighbors went through and got all of the contact information for all of the, and thank you to Louise for doing that, on all of the county clerks. And so we included those phone numbers there where people can contact the county clerk and get the contact information for each of the candidates and reach out to the candidates and find out where they stand. So again, we hope it’s a great… a great tool, but over on, on what you’re doing all the time, uh, we talk about it on a regular basis, but, but we need to continue to talk about how important it is that people contact you, uh, right away after some kind of a situation has occurred in their lives.

Yeah. I keep, keep talking about it because I keep having phone calls with people that, uh, put off making that phone call because they’re either being duped by an insurance carrier or somebody that they don’t need to contact a lawyer, or they don’t understand how things work on my end and they’re afraid to talk to a lawyer or think it’s going to cost them an arm and a leg. Both those things are, both those reasons are big mistakes. And, uh, Of course, my consultations are free, whether they’re on the phone or whether I invite someone in to have a longer, lengthier consultation with me in person. And time is always of the essence with any kind of a legal matter, especially when it comes to a personal injury matter, because stories change. People can disappear. You’ll want to lock down as an attorney. the witnesses, get the facts, make sure that you’ve got things established so that your client has a path to victory. And that means getting compensated for what happened to them, whether it’s a motor vehicle accident, a trip or slip and fall, dog attack, anything that hurts someone. Same thing with a work-related injury. It’s very important to do the right things early on. or it can be a real problem for whoever has an on-the-job injury. Any kind of legal matter, but especially personal injury matters, people need to reach out and not hesitate. And if someone’s out there listening and they’ve got a friend, a neighbor, a co-worker, maybe a family member, a son or daughter, a husband or a wife that’s had something happen, and they’ve not called me, they need to do so as soon as possible. I’m just going to give good, sound advice. It doesn’t mean I’m going to take the case, but I’m going to talk to folks. I’m going to help them with that situation, get them on the right path. And that is a very important number to remember. One other thing, John Bozen, I can’t believe that we are at the middle of October. It seems like, gosh, I remember, I think it was like the first week of October, there was a significant blizzard. That was probably 30 years ago, maybe, or something like that.

I remember that when I was here. Yeah, folks, winter is right around the corner. It could happen very soon. Cold weather does things to cars. Now is the time to prepare your vehicle and get ready for the cold weather that is just around the corner. That means having your car tuned up, getting things working properly, new tires or tires that are better in the snow. Minimum, all weathers. But here in Colorado, we benefit by having those studded tires. They do make a difference. Now is the time to get those things done.
SPEAKER 06 :
Windshield wipers need to be in good repair. Oh, yes, absolutely. And then also make sure that you have your window scraper in your car because the weather can change so quickly in Colorado. And there was one time where I think I’d taken my scraper out because it was summertime. And it’s like, oh, I need that. So make sure you have that in the car, too.
SPEAKER 17 :
Yep, make sure that defroster is working, all those things. Yeah, I can recall many occasions watching people going down the road. No way they can see out the window. Half an inch of ice on there. What are they doing? What are they trying to do?

You don’t want them to cause an accident, but if they do, then the victim needs to talk to John Bozen and Bozen Law. And Joe just said in my ear, remember washer fluid as well. That is super important, too.

Good morning, Kim, and good morning to all our listeners.
SPEAKER 06 :
Well, and boy, there’s a lot going on. So first of all, though, the original Constitution, you have the fourth edition, which is referenced now as the historical meaning of America’s supreme law. Why did you end up coming up with a fourth edition?
SPEAKER 08 :
That’s a great question. This book was first published in 2009. And it had the usual first edition type problems, like typos. And so we corrected it with a second edition that lasted five years. But then we had so many constitutional developments people wanted to know about, even though the original constitution hadn’t changed, that we came out with a third edition in 2015. Well, basically the same thing happened and has driven the production of the fourth edition. A lot of stuff has gone on.
SPEAKER 06 :
Well, definitely. And when you mention edits or proofing errors, we just completed our Colorado Union of Taxpayers ratings report. And I was cross-eyed as I was trying to finish that up. And our board meeting was last night. And I said, if you see any typos or edits, don’t tell me tonight. Tell me tomorrow. I just needed a break on that.
SPEAKER 08 :
Yeah, they always get through. I mean, no matter how many times you edit, it’s amazing. But anyway, the same thing happened between the time of the third edition and the fourth edition, and that is a lot of things that happened. The Trump administration is a gift. Well, as the Biden administration was a gift to constitutional commentators, because all of these issues come up. So we had two Trump impeachments. We had suits during the first Trump administration claiming he violated the Constitution’s emoluments clause and on and on. And so what we did with the fourth edition is we took the available information that we had from the founding era and we clarified what things like high misdemeanors in the impeachment section of the Constitution means and what the term emoluments means. Previous to that, while we mentioned it, we had no particular reason to emphasize it. So the fourth edition still is a commentary on the same Constitution, but it’s been updated to reflect public interest.

You’re very welcome, and let’s try to avoid the shoals, shall we?
SPEAKER 03 :
Okay. There you go. I have been noticing a trend. I attend, or I should say we, family and friends, go to a lot of political events, and I’ve noticed when I go online, the venues of excuse me, where the venues are being held. The location is not published anymore. You have to purchase the tickets and then they publish where the venue is. And I kept thinking about our Constitution, our freedom of speech, our right to assemble peaceably, and not to impede on our rights. And we’ve got… I think the reason that is is there’s threats in this, as Tim would say, we are in such a time as this. And wanted to get your perspective on just where maybe the courts stand in this battle. I think it’s a monumental battle.
SPEAKER 08 :
Clarify for me what kind of event you’re thinking about where the venue is not advertised.
SPEAKER 03 :
They’re Republicans. The Lincoln Day dinners, I mean, they’re not publishing the locations. The one Debbie Perry Smith just did in Arvada. And, right, they want to know that you are, you know, I’ll say a friendly person.
SPEAKER 08 :
My immediate comment on that is we have a problem. I first noticed this problem back in 2008. I was helping a friend of mine moderate a website, a political website. and we had a lot of participants from both sides of the aisle. And I began to notice that a lot of the participation coming from the left was not coming from traditional liberals. You know, liberals traditionally, they didn’t think much about economic rights or property rights, but they were very big on civil liberties, including freedom of assembly, freedom of speech, and they respected your right to do those things. What I noticed beginning at this time was that an increasing number of people who were coming from the left were authoritarian. They were not liberals anymore. They were basically, probably a better word is totalitarian. They saw no limits on government, and they wanted everything done their way, and anybody who did anything any other way didn’t have any rights at all. And true to form, that has in fact gotten worse and worse in America. We have raised a generation, and I don’t mean to say this is just an age thing, But we’ve raised a generation of civic barbarians who don’t believe in fundamental rights. And that, I think, is why people, especially people on the right side of the spectrum, feel they have to protect themselves against violence. I think there are a number of reasons for this. One poll that came out last year indicated that these totalitarian types were disproportionately people who were fairly recently educated at prestige educational institutions, at colleges and universities. And as a refugee from academia, I can tell you that while academia all through my career was left of center, it grew increasingly authoritarian. And so you’re turning out people who basically live in a little bubble. They’ve never heard other ideas, and so they assume that anybody who doesn’t share their ideas is evil. So as I said, it is a real problem. And the solutions, well, that would require perhaps a whole program. I’ve got a number of possible ones. But let me just suggest one. I think that we send entirely too many people to college. We send people to college who aren’t really interested in learning critical thinking. and we are creating massive bureaucracies, including diversity, equity, and inclusion bureaucracies in colleges and universities. And that is largely due to the huge infusion of federal money through the student loan program. The student loan program, in my opinion, has turned out to be a disaster on several different levels and should be terminated. And that way, at least, we might begin to shrink this overly bloated, overly ideological sector back down to size, and perhaps not quite as many people would get indoctrinated.
SPEAKER 06 :
Well, thank you, Rob Nadelson. And Sandra, your question is such an important one. The radical activist left has accused the big, broad middle of America of, well, and also the Republicans as wanting to foment racism. But when we look at the reality, it really is the far, far left. And of course, with this big No Kings rally that’s being scheduled for the 18th this Saturday, this is a big deal. And you’re not going to see… I don’t think you’re going to see, again, the big broad middle. That would be your moderate Democrats and unaffiliateds and Republicans and conservatives and libertarians out there trying to shut down these voices because we do believe in freedom of speech, but yet they did shut down the voice of Charlie Kirk.
SPEAKER 08 :
You know, Kim, one of the problems related to this is the creation of ideological bubbles. Now, that’s always been a problem. It’s not new. But these ideological bubbles exist on the left. Not so much among conservatives, because we can’t get away from hearing the other side. You know, the other side is everywhere. It’s in the atmosphere. Environmental propaganda, for example, everywhere. But the other side can conceal themselves in a little bubble. I ventured, Kim, this morning to listen for just a few minutes to one of the talk shows that represent your evil competitors. And they had a socialist woman on who apparently is active in Colorado politics. And she made the comment that crime is the product of poverty. Poverty causes crime. She didn’t say it contributes to crime. She said categorically crime is a result of poverty. And I say to myself, how could anyone believe that? I mean, all through history, we’ve had poor societies that weren’t necessarily criminal. People were desperately poor during the Great Depression, and we didn’t have this kind of crime wave. And the host pointed out that a lot of people commit crimes that have nothing to do with property or need to support their families, like rape, for example. But she believed this because she’s raised in an ideological bubble, and she’s never been exposed to other points of view or to the lessons of history or to basic criminology. This bubble problem is one – well, bubbles fester this kind of ideological totalitarianism or authoritarianism that causes people to turn violent. We have to find a way to pierce those bubbles. It’s something I’ve just begun to think about.
SPEAKER 06 :

There’s been a lot of talk from the left last few years about that our democracy is under threat. So my question to you is, does our Constitution reflect a democracy or a republic?
SPEAKER 08 :
That’s a great question, and it’s not an easy one to answer. The founders did not draw a sharp distinction between a democracy and a republic. Sometimes they called the American system of government democracy. Sometimes they called it a republic. I’ve been trying to sort this out, to figure out what their meanings are for a number of years. And basically what I’ve concluded is this. When they used the word republic, they meant most of them, not all of them, meant a government that first did not have a king. A monarchy is inconsistent with a republic. Secondly, that followed the rule of law, that didn’t just imprison people or go as it went along without any rules. So it could not have a king. It had to follow the rule of law. And then ultimately, a republic had to be responsible to the citizenry. It could be a large citizenry, such as we have in America today, or it could be a state like Athens, let’s say, where the citizenry was pretty narrow. In the Federalist Papers, there is some discussion of a concept that Aristotle raised called pure democracy. And the founders believed that pure democracy was inconsistent with republicanism. What they meant by pure democracy is a system, if it can be called that, where all decisions are made by the mob. that there are no magistrates at all, that you hold a meeting and you decide whatever you want to do at the moment, and you don’t follow the rule of law. And because you don’t follow the rule of law, it’s not a republic. Many conservatives try to draw a very sharp distinction between democracy in general and republican in general. And I used to believe that was so, but it’s not really an accurate distinction. The distinction is between a republic on the one side and a pure democracy on the other. And so finally, to answer your question, from the founders’ view, they were setting up both a republic and a constitutional democracy. Not a pure democracy, but a constitutional democracy.
SPEAKER 06 :
Excellent question and excellent explanation on that, Rob Nadelson. We’ve got Wyatt in Wyoming on the line. Wyatt, what’s your question for Rob Nadelson?
SPEAKER 18 :
Hi, Wyatt. Well, good morning, both of you. It’s regarding property rights. Can you tell me where in the Constitution it says that the U.S. government can own all this federal property? The state of Utah is almost 80% owned by the federal government. I think Nevada is even more so. And then the second question I’d have is that when they come in with a conservation easement, how can they have it say that it goes into perpetuity?
SPEAKER 08 :
Okay, well, let’s respond to that in inverse order. Property law used to be my specialty, and so I won’t have any trouble with the easement question. Easements can be held in perpetuity or they can be held for a shorter period of time. It all depends upon the terms of the grant. And so you can create any kind of easement. It could be an easement for passage over land or a conservation easement, which is a kind of easement we call a negative easement. And that can be done in perpetuity if parties, the buyer and the seller, agree. As to the issue of federal lands, actually, the figure in Utah is about 66 percent is federally owned. And you’re right that Nevada is even higher. It’s 87 or 88 percent is owned by the federal government. Now, let me tell you what the courts say, and then I’ll tell you my view of it. What the courts say is that the property clause in the Constitution, which you’ll find in Article 4, the reference to federal property, enables the federal government to hold land for pretty much any purpose. And it can hold it in perpetuity, or it can dispose of it, or it can acquire it. That’s been the rule followed by the U.S. Supreme Court since about 1938. My own view is that that’s wrong, that the government has the ability, has the power to hold property, that it is acquired by treaty, but it can’t hold property in perpetuity unless it does so for an enumerated purpose. So, for example, the government has the right to run post offices. Obviously, as part of the right to run post offices, the government needs to be able to acquire land for property. the post offices themselves, or the government needs forts and other military installations. The government has to have the right to acquire land for those purposes, and that sort of thing is actually mentioned in the Constitution. But the idea of the federal government holding land for unenumerated purposes, that is, for parks or simply because it wants to hold the land in perpetuity, is, I don’t think, constitutionally permissible. Now, before somebody goes half-cocked and says, Nadelson wants to put up condominiums and McDonald’s and all the national parks and sell them off and everything, that’s not what I’m saying. What I am saying is that environmental treasures like the national parks don’t need to be held by the federal government. They can be held as such treasures are held in Britain by permanent trusts that will protect them for future generations. But I don’t believe, and I think this is kind of implicit in your question, that the federal government has the right to own land indefinitely just because it wants to hold the land indefinitely. One last point. The founders didn’t believe that either. And when the founders drafted the Constitution, they drafted it upon the assumption that most land would be either held privately or by the states. When the federal government owns 88% of the state, as it does in Nevada, or 66% as it does in Utah, that gives the federal government far too much power over the states for the federal system to work properly. And so that is a problem. It’s more than just a theoretical problem. It’s a practical one.
SPEAKER 06 :
Okay, thank you. Follow-up question on anything, Wyatt?
SPEAKER 18 :
well i thank you for that my question then would be okay if the federal government or even the state government owns property they have essentially taking that off taken that off of the property or the tax rolls yes the budget for say let’s say the county the county owns property has taken property or bought property in the county or the city. Even better example, the city has bought property in the county. That property has been taken off of the county tax rolls. Therefore, my property tax has increased to cover the amount that is no longer taxed because the city owns it. I argue that I am now subsidizing the city to own property in the county. How do we go about rectifying that, I guess, is the question.
SPEAKER 06 :
And let’s keep that as a cliffhanger on that. That is an excellent question. I’m talking with Rob Nadelson. He’s a constitutional expert. And Wyatt in Wyoming has posited a very interesting question about as government, the municipal or state, county is acquiring more land. They’re not lowering their budgets. So what that means, that’s taking land off of the property, off the tax rolls. So that burden is going to be falling on the private property owner. We’ll keep that as a cliffhanger. Great question that is asked by Wyatt in Wyoming, and that is, is this government, local, county, state is acquiring more land. We can see this through open space. using actually tax dollars or lottery funds to buy open space, takes that land, that property, off of the tax rolls. We don’t see governments reducing their budgets, so that burden is going over to the citizen. Am I getting that, setting that up the way you wanted it to be?
SPEAKER 08 :
There were actually two parts to the question, and I’ll address that one in a minute. But first he asked about the fact that the federal government takes this land away out of the private sector and therefore doesn’t pay taxes. In partial defense of the federal government, there is a system called payment in lieu of taxes, or PILT, P-I-L-T. And it’s a system whereby the federal government actually gives money to local governments to reflect the fact that that land has been taken off the tax rolls. If you’re curious about PILT payments in lieu of taxes, there’s a website, which is DOI, as in Department of the Interior, doi.gov forward slash PILT, P-I-L-T, doi.gov forward slash PILT. The other part of his question referred to state and local ownership of land. And that’s not something I can answer constitutionally, because the states pretty much have unlimited sovereign power, except as limited in their own constitutions and in the federal constitution. And so the states can own anything they want. And The cities get their power from the state governments, so they could own anything that’s authorized by the state government. So the only real response to that is the political process, and that is to let representatives know that you oppose a particular program of acquisition of land or that you would like state or local land to be disposed of. or if it’s state land that you’d like the state to pay something like PILT to the local government to help subsidize local services. So that’s really a political question rather than a constitutional one. And like most political answers, it’s not entirely satisfactory. A follow-up question?
SPEAKER 18 :
I thank you for that question. My understanding of it was as a territory became a state, they were to release, the federal government was to release all of the lands to the state. So again, that begs the question, where did the BLM, where did the National Forest come? all of these other entities that have, federal entities that own land, where did they come from, or how are they derived, and from what constitutional perspective do they derive their powers?
SPEAKER 08 :
Okay. This land was generally, BLM land, for example, was generally acquired by treaty. It was, in some parts of the country, it was acquired from France through the Louisiana Purchase. In other parts of the country, it was acquired from Mexico through after the Mexican War, and then the federal government simply continued to own it rather than dispose of it as the founders had envisioned. The deal between the states where they entered the union and the government was enshrined in what are called enabling acts. These were laws. Wyoming has one. Colorado has one. These were laws that were passed by Congress, setting forth the condition under which Congress agreed for these territories to become states. And while they generally provided that some land would be turned over to the states, for example, land to help support the public school system, they generally also said that the federal government can retain most of the land within the states, and the states can never question that. That was… That’s something that I’ve explored in the past because it wasn’t exactly an equal bargain, was it? I mean, if you’re in Wyoming territory or you’re in Colorado territory and you want to be a state and be self-governing, you’re going to have to agree to almost any conditions the federal government imposes upon you. And so it wasn’t really an equal bargain. The Fed said, if you want to elect your own local officials, your own state officials, you’re going to have to agree to allow us to retain half the land in your state or 60% of the land in your state. Whether that can ever be challenged today is dubious, but there have been groups formed with the idea of maybe eventually challenging it in court.
SPEAKER 06 :

Okay, it’s not a question, it’s a commentary. The land all belongs to we, the people, first off. Second off, I’m going to bring you all the way around to Tina Peters, the Truth Matters site on Rumble. You look at all the stuff she’s got on there, the Venezuelan connections, whistleblowers, you know, Serbia. And what I’m telling you is the elections have been so compromised that that’s how the power has been taken away on our lands. And every way there is.
SPEAKER 06 :
Okay, thanks, Gammy. Thanks, Gammy. Okay, and Rob Nielsen, we only have about a minute left. How would you like to wrap this up?
SPEAKER 08 :
Well, let me just say that the issue of federal lands goes back to the 19th century. It is not related to local electoral problems. The other thing I wanted to mention is regarding the so-called government shutdown. I’d like the people to understand what this really is, okay? The federal government, the Congress, passes a law called the debt limit. It sets a maximum on how much the federal government can borrow in new debt. When the government hits that limit, Congress has to pass a new law raising the debt limit so we can go further into debt. All the shutdown means is that we’ve hit the debt limit and we can’t go further into debt. In other words, what it means is that during the period of the so-called shutdown, the federal government is running a balanced budget. I don’t think that’s so bad.
SPEAKER 06 :
